Definition
“Unsafe Vessel Speed” means operating any motorized watercraft at a speed greater than X MPH on public waterways, or at a speed that creates a foreseeable risk to persons, property, wildlife, or other vessels, including but not limited to wake damage near shorelines, docks, marinas, or congested areas.
“Public waterway” includes rivers, lakes, reservoirs, canals, bays, and coastal waters within San Andreas jurisdiction.

Classification
- Primary Class: M (Misdemeanor)
- Enhancement: Escalates to I or F if aggravating factors apply (see below)
- Default Cap: 45 MPH on any public waterway within the State of San Andreas
- No-Wake / Marina Zones: 15 MPH (when posted or within 300 ft of docks, ramps, swimmers, or anchored vessels)

“Public waterway” includes rivers, lakes, reservoirs, canals, bays, and coastal waters within San Andreas jurisdiction.
Elements of the Offense
A person commits Unsafe Vessel Speed when they:
- Operate a motorized vessel on a public waterway, and
- Exceed 45 MPH (or 15 MPH in no-wake/marina zones), regardless of traffic conditions, or
- Operate at any speed deemed unsafe based on conditions (visibility, congestion, weather, proximity to swimmers/docks/shoreline).
Penalty Schedule
Base Offense (Standard Conditions)
- Class: M
- Fine: $1,500
- Jail: 0–1 months
- License Points: 3 points (Boating Permit / Operator License)
Applies if any of the following are present:
- Exceeds cap by 15 MPH or more (40+ in a 25 zone), or
- Operates within 300 ft of swimmers, docks, ramps, anchored vessels, or shoreline congregation areas at unsafe speed, or
- Creates excessive wake that causes property damage, collision, or forces evasive action.
- Class: I
- Fine: $3,500
- Jail: 1–3 months
- License Points: 5 points
Applies if the speeding:
- Causes bodily injury, or
- Causes a collision with serious damage, or
- Occurs during evading law enforcement, or
- Is combined with impairment (boating under the influence).
- Class: F
- Fine: $7,500
- Jail: 3–8 months
- License Points: 8 points
- Mandatory Suspension: 30–90 days boating permit (judge discretion)
Administrative Actions
- 3+ points in 30 days: Mandatory safety course eligibility review
- 8+ points in 60 days: Temporary suspension recommended
- Repeat offense (within 14 days): Treat as Aggravated automatically
Enforcement Notes
- Speed may be established by radar, pacing, air/shore observation, buoy-marked zones, or validated vessel tracking systems.
- Officers may issue additional charges where applicable (Reckless Endangerment, Evading, BUI, Property Damage, etc.).
