Base Excessive Speed Definition:
• 100 MPH or greater regardless of posted limit
School / Construction Zones:
• 15 MPH or more over posted limit automatically qualifies as Excessive Speed

Definition
“Habitual Excessive Speeding” means operating a motor vehicle at a speed exceeding the statutory excessive threshold and having one or more prior excessive speed convictions within a defined lookback period.
“Repeat Offender” means a person who has been convicted of Excessive Speeding one (1) or more times within the preceding 24 months.
“Public roadway” includes highways, interstates, municipal roads, residential streets, and any publicly maintained transportation route within the State of San Andreas.

Elements of the Offense
A person commits Habitual Excessive Speeding when they:
• Operate a motor vehicle on a public roadway, and
• Exceed the speed threshold (25+ over or 100+ MPH), and
• Have a prior Excessive Speed conviction within 24 months

Second Offense (Within 24 Months)
Class: M
Fine: $3,000
Jail: 1-2 months
License Points: 5 points
Mandatory License Suspension: 1 Week

Third Offense (Within 24 Months)
Class: F
Fine: $6,000
Jail: 2-4 months
License Points: 8 points
Mandatory License Suspension: 1-2 Weeks
Vehicle Impound: 14 days (mandatory)

Fourth or Subsequent Offense (Within 36 Months)
Class: F
Fine: $15,000
Jail: 4-7 months
License Points: 12 points
Mandatory License Revocation: 2-3 Weeks minimum
Vehicle Forfeiture: Subject to court determination

Aggravating Factors (Applies at Any Level)
Enhancement applies if speeding:
• Exceeds 120 MPH, OR
• Occurs in a school zone during posted hours, OR
• Occurs in an active construction zone, OR
• Involves street racing participation, OR
• Causes property damage or forces evasive action by another driver
Penalty Enhancement:
Automatic elevation to next classification tier

Felony Enhancement (Reckless / Injury / Major Risk)
Applies if the excessive speeding:
• Causes bodily injury, OR
• Causes a collision with significant property damage, OR
• Occurs while evading law enforcement, OR
• Is committed while under suspension for prior excessive speeding
Penalty (Felony Enhancement):
Class: F
Fine: $30,000
Jail: 10-24 Months
Mandatory License Revocation: 1 Month minimum
Vehicle Forfeiture: Mandatory upon conviction

Administrative Actions
• 8+ points within 12 months: Mandatory defensive driving course
• 12+ points within 18 months: Automatic suspension review
• Repeat offense within 30 days of prior citation: Automatically treated as next offense tier
• Judges may require ignition interlock or telematics speed monitoring for reinstatement

Enforcement Notes
Speed may be established by radar, lidar, pacing, aircraft enforcement, automated speed detection systems, or validated vehicle telemetry.
Officers may issue additional charges where applicable (Reckless Driving, Street Racing, Evading, DUI, Endangerment, etc.).
